However, this book cannot serve as a complete guide to all the rules you need to know. For one thing, the exact rule in your court system may be somewhat different from the example we give. In that event, knowing about another similar rule—either a federal rule or another state’s rule—can help you locate the rule in your state. (See Chapter 23 for information on doing your own legal research.) Also, each court system has its own procedural rules that, though important, cannot be covered in this book. For example, local court rules set time limits for filing various kinds of documents and page limits on the length of those documents. You will have to learn and comply with these local requirements.
I've been accused of overstating former Vice President Joe Biden's potential in the 2020 presidential primary. After all, he's a gaffe-prone septuagenarian who touts occupational licensing reform and maintaining our private health insurance industry. And he's in a Democratic Party led by a socialist who honeymooned in the Soviet Union and a 29-year-old former bartender who believes that "like, the world will end in 12 years" because of climate change.
In September 2017, Judge Richard Posner abruptly resigned from the Seventh Circuit. In subsequent interviews, Posner explained that he resigned in part because of his disagreement with his judicial colleagues over the Seventh Circuit’s treatment of pro se litigants (those litigants who appear before courts without lawyers).1 In particular, Posner thought the court wasn’t “treating the pro se appellants fairly,” didn’t “like the pro se’s,” and generally didn’t “want to do anything with them.”2
We’re pro se litigants, and we talk to other pro se litigants all day every day, probably more than any lawyer does. I can tell you no one needs to “pit” pro se’s against lawyers; you guys have that covered. 1. If you don't know where your federal court is, look under "U.S. Government Offices ‹ U.S. Courts" in the blue or green pages of your phone book. When you find out which district court is yours, add it at the top of your pro se where it reads, "in the United States District Court for the [ ] district of [your state]." Don't worry yet about the Civil Action No. The clerk will give that to you at your district court office.
In a California study of family matters, one party appeared pro se in 2/3 of all domestic relations cases and in 40% of all child custody cases in 1991-95. California reports in 2001 that over 50% of the filings in custody and visitation are by pro se litigants. Urban courts report that approximately 80% of the new divorce filings are filed pro se.
128. However, this result is not robust against a different choice of years. For example, while the point estimate is still negative, the 95 percent confidence interval for a regression run on data from 1999 through 2006 includes zero (though the 90 percent confidence interval does not). Thus, the better takeaway at this point is not that the reform has had a negative impact on win rates but that it has not had a significant positive impact on win rates.
Conversely, pro se litigants who make mistakes lose day in and day out, even with minor infractions. This is most often due to lack of knowledge, but judicial bias and lawyer tricks add another layer of peril. Lawyers know how to avoid default judgments, dismissals, and summary judgments. Pro se litigants rarely do. Lawyers skillfully “handle” pro se opposition. Most pro se litigants don’t handle lawyers or their own cases. In the end, most lose and they do so very quickly.

Unfortunately, the ideal of the multi-door courthouse is at odds with how courts traditionally operate: to support and enhance the lawyer business by making it extremely difficult to get through court without a lawyer. As long as courts are institutionally biased against creating a level playing field for the self-represented, it will make no difference how many doors a court has.
Some pro se litigants are intelligent and sophisticated. I recall one individual who represented himself in a case that proceeded to jury trial. He proved quite capable, and the verdict was in his favor. In other cases, the pro se parties are long on emotion and short on knowledge regarding law and procedure. This puts the judge in an uncomfortable position.
Lawyers and their bar associations who do get a glimmer of the access problem tend to think that it's strictly a money issue. They focus their efforts on pro bono services or what legal services programs still exist. This clearly confuses the forest for the trees. Poor and rich alike have a right to use the courts without an intermediary. Or to use a popular means of expressing a fundamental point: It's the monopoly, stupid. It probably is no coincidence that by directing their efforts towards the poor, lawyers are addressing the access problem only for people who can't afford to pay lawyers.
People who can't afford a lawyer are a rebuke to the organized bar's monopoly over legal services, because that monopoly is morally--if not legally--justified only if the legal profession is able to provide affordable justice for all. The lawyer bias against the self-represented is a clear case of blaming the victim--even though for years, the ABA has admitted that 100 million Americans can't afford lawyers.
