Many years ago, after winning a motion, an older judge asked me to stay behind after the parties left. He took me aside and said simply: "I want you to know that the case before yours today was to protect a little girl who's grandfather thinks it's fun to extinguish cigars on her legs." I knew what he wanted me to know, and I never forgot. Other people's cases are serious, too.
The regression is run with five different sets of specifications. The first regresses outcomes against a dummy for whether the case took place with EDNY reform; the second model adds a dummy variable indicating whether each case took place in EDNY; the third model adds dummy variables indicating which district court each case was filed in; the fourth adds dummy variables for the year the case was filed (but removes the district dummy variables); and the fifth model includes dummy variables for both the year and district for each case.126
While most litigants are plaintiffs, about ten percent are defendants. The legal challenges facing the clinic’s visitors are varied and diverse: for example, clinic visitors have included an immigrant woman sued by a hospital for payment of her late husband’s medical bills and threatened with having her wages garnished; a woman who sued the police after her home was broken into by police with drawn weapons while her toddler granddaughter was playing on the floor; and a woman who sued her employer for sex discrimination and through mediation received a five-figure settlement.
133. For example, this Comment does not consider how many resources would be required to enact civil Gideon nor whether they could be better used elsewhere. It also does not consider whether civil Gideon itself would be effective at improving civil pro se outcomes. While the experimental literature discussed earlier suggests that access to counsel improves case outcomes for pro se litigants, it is unclear whether a similar quality of counsel would be provided in a civil Gideon world. Indeed, the success of Gideon in the criminal context is a hotly debated subject, with many scholars considering it a disappointment. Some pro se litigants are intelligent and sophisticated. I recall one individual who represented himself in a case that proceeded to jury trial. He proved quite capable, and the verdict was in his favor. In other cases, the pro se parties are long on emotion and short on knowledge regarding law and procedure. This puts the judge in an uncomfortable position.
This surprisingly easy hack is one that can be done anytime, anywhere--and is rarely done enough. People underestimate the power of an erect spine or a rigid stance. Carrying yourself like you are proud to be who you are indirectly gives your brain feedback that you are indeed a lovely human, so that you subsequently positive feelings about yourself. Who knew the body could be such a powerful tool?
Accept all complaints, petitions and responses filed, in whatever form, and create user-friendly forms. Among the most obvious of barriers to equal access are rules governing the form of the papers people need to start a lawsuit or defend themselves if they are sued. Complicated pleading rules definitely operate to deny equal access. In fact, a simple plain-English statement of claim (as is used in many small claims courts) or a fill-in-the-blanks, check the boxes type of complaint form used in California courts is all that's needed in most common kinds of cases. Later, the legal and factual issues can be sorted out by a mediator or judge. The Superior Court of Maricopa County has created a number of easy-to-use forms for its Family Court, and by all accounts, people are able to handle them with little help from court personnel.

Data is unavailable for three policies: procedural assistance by clerk’s office staff members as part of their regular duties, appointment of counsel to represent a pro se litigant for the full case, and appointment of counsel to represent a pro se litigant in limited circumstances. See id. Although it would be interesting to conduct an analysis similar to that conducted in the following Section for each of these policies, there is no obvious reason that the absence of this data would undermine any of the following results beyond the fact that an analysis similar to that conducted below could conceivably come to different conclusions for those policies.

A number of commentators have trumpeted reforms at the trial court level geared toward assisting pro se litigants as a possible solution.8 These reforms usually aim to give pro se litigants access to resources and information that can help them successfully navigate the legal process, reduce their costs, or provide them with assistance from courts’ offices.9 Examples of reforms that have been implemented include providing pro se litigants with access to electronic filing systems that make it easier to file lawsuits and monitor proceedings, allowing pro se litigants to communicate with law clerks about their claims and proceedings, and publicly disseminating information about resources that may be available to pro se litigants through the court or third parties.10 Critically, these reforms can be implemented by the trial courts and their staff and do not require significant additional contributions from attorneys, clinics, or other legal institutions. Accordingly, these programs can help pro se litigants without diverting legal resources away from other causes, including indigent criminal defense. A large number of federal district courts have already implemented at least some of these procedural reforms aimed at helping pro se litigants.11
What is a Pro Se Complaint? This is, quite simply, a lawsuit that a person files without a lawyer. The ADA Pro Se must be filed in Federal District Court., because the ADA is a Federal law. To find out which US District Court you will be filing your complaint in, look in the phone book blue (or green) pages, under United States Government Offices, "U.S. Courts".
From October 2016 through September 2017 clinic staff members assisted 874 individuals in a variety of ways. In most cases, staff and volunteers provide advice and counsel, including providing referrals to other services or pro bono attorneys. In some cases, clinic staff members provide more extensive assistance, such as helping litigants draft court filings.
The center’s approach, known as “limited-scope legal assistance,” can fill an important void. Most federal courts devote substantial resources to pro se litigants, such as handbooks and staff time answering process questions, and pro se staff attorneys help judges process cases. But court staff may not give legal advice to litigants, and although private lawyers offer some volunteer assistance, they cannot meet demand.
No Guidance on Timing or Parties. The forms do not give any guidance on when certain kinds of pleadings or claims or defenses have to be raised, or who has to be sued. Some pleadings, claims, or defenses have to be raised at a certain point in the case or within a certain period of time. And there are limits on who can be named as a party in a case and when they have to be added. Lawyers and people representing themselves must know the Federal Rules of Civil Procedure and the caselaw setting out these and other requirements.
