If you go by calls and emails Jurisdictionary receives, there's good reason for this! Lawyers who bail at the last minute. Lawyers who don't know what they're doing. And, worst of all, lawyers wishing to curry favor with judges, afraid to stand up to the buffalo in the black robe and demand their clients' rights by making timely objections and threatening appeal.
Now most pro se litigants are at a disadvantage in contested litigation. It may be awkward or inappropriate for them to appear both as counsel and as a witness. They're deprived of the judgment of an independent third party in framing the case, in evaluating how to present the evidence and in forming legal arguments and also in making sure that it is reason rather than emotion that steers how the case is conducted. That's why Judges sometimes warn a party who is proceeding pro se of the old saying that anyone who represents himself in court has a fool for a client and an ass for an attorney.

7. At least some commentators have expressed concern that allocating more legal resources to pro se civil litigants might take away from resources needed for indigent criminal defense. See Barton and Bibas, 160 U Pa L Rev at 980–81 (cited in note 5). It is important, however, to recognize that legal resources also may trade off with nonlegal resources, and an analysis accounting for these trade-offs may make the economics of expanded legal resources for pro se litigants look more attractive. Additional money spent on lawyers or pro se assistance might be more economical than it first appears if, for example, additional state spending in an eviction or wrongful termination proceeding saves the government from paying for homeless shelters or welfare assistance at a later date.

Courts across the country are increasing the resources available to the surge of pro se litigants attempting to navigate the judicial system. Courts are not only addressing the legal and procedural obstacles facing pro se litigants, but they are also focusing on “sociological [and] psychological aspects of how unrepresented litigants feel about the overall litigation experience.” Id. at 3. Likewise, attorneys, and civil trial lawyers in particular, must be cautious of the challenges and special considerations involving pro se litigants.

Unfortunately, the ideal of the multi-door courthouse is at odds with how courts traditionally operate: to support and enhance the lawyer business by making it extremely difficult to get through court without a lawyer. As long as courts are institutionally biased against creating a level playing field for the self-represented, it will make no difference how many doors a court has.
Department of Social Services,37 the appellant argued that failing to provide counsel in a civil suit that would terminate parental rights violated the Due Process Clause.38 A 5–4 majority on the Supreme Court held that there was no general right to appointment of counsel in parental termination proceedings despite the importance of the right involved. The Court explained that a

Going to court is never an enjoyable experience. With the substantial cost of attorney fees, having to gather a significant amount of evidence, and having to spend lengthy amounts of time in the lawyer’s office, fighting for your legal rights becomes overwhelming. There is a solution, however. Pro-Se Litigation is a type of legal strategy in which you represent yourself in civil suits. Luckily, there is hope; you…

Dripps, Why Gideon Failed: Politics and Feedback Loops in the Reform of Criminal Justice, 70 Wash & Lee L Rev 883, 894–99 (2013). But see Wilkinson, 67 Vand L Rev at 1127–29 (cited in note 3) (arguing that criminal defense lawyers appointed to represent indigent defendants are typically effective).
In order to evaluate the effects of different pro se reform measures undertaken by district courts, this Section compares the win rates of pro se litigants in courts that have enacted each of the reforms discussed in the FJC Survey with the win rates of litigants in the districts that have not enacted those same reforms. Table 3A compares the win rates for plaintiffs in cases in which both parties are represented with those in which either the plaintiff or defendant is pro se based on whether the district court employs a particular policy.

 D. Before trial,  the parties may be given an opportunity to meet  with a mediator appointed by the Judge to resolve their case. Mediators are volunteers; they try to help parties reach a friendly agreement. They are  not judges and do not make decisions. If the dispute is not resolved in mediation, the parties will proceed to a trial, usually on the same day.
Accept all complaints, petitions and responses filed, in whatever form, and create user-friendly forms. Among the most obvious of barriers to equal access are rules governing the form of the papers people need to start a lawsuit or defend themselves if they are sued. Complicated pleading rules definitely operate to deny equal access. In fact, a simple plain-English statement of claim (as is used in many small claims courts) or a fill-in-the-blanks, check the boxes type of complaint form used in California courts is all that's needed in most common kinds of cases. Later, the legal and factual issues can be sorted out by a mediator or judge. The Superior Court of Maricopa County has created a number of easy-to-use forms for its Family Court, and by all accounts, people are able to handle them with little help from court personnel.

Variations Possible.  A form may call for more or less information than a particular court requires.  The fact that a form asks for certain information does not mean that every court or a particular court requires it.  And if the form does not ask for certain information, a particular court might still require it.  Consult the rules and caselaw that govern in the court where you are filing the pleading.
