One judge said, “I tell them they have the same right to represent themselves in court as I have to the handling of my personal plumbing problems, i.e., I don’t . . . they shouldn’t.” Another judge cautioned pro se litigants that “doing your own legal work is like doing your own mechanic work. Most of us could do it if we had the time and the patience. But you need to recognize that if it still doesn’t run, you have to look at who did the work.” Id.
Know the Rules of the Road.  Before filing a lawsuit, you must carefully read your state’s code of civil procedure and the court’s local rules. If you also have federal claims and wish to file in federal court, then you must read the Federal Rules of Civil Procedure, as well as the particular district’s local rules. In addition, some judges have their own rules called local local rules. You must familiarize yourself with these rules as well.  
If the pro se plaintiff fails to make a jury request, defense counsel should think hard as to whether a jury trial should be requested. Will the pro se plaintiff gain momentum in the eyes of the jury, simply because they are acting on their own behalf? Will defense counsel automatically be seen as part of the “system,” regardless of the merits of the case? Or, will the plaintiff come across as an unreasonable “zealot” who is out to seek revenge against the defendant with an incoherent set of facts and unlikable witnesses?
I can definitely use these services. I am a well respected but hated pro se litigant. Why do attorneys get upset or angry when you have a lot of court cases even though none or criminal? Less tangibly, it may be the case that pro se reforms improve the litigation experience for pro se litigants and help ensure that they feel they have had a fair hearing in court. Increasing satisfaction with court proceedings is a significant benefit to litigants and also boosts the public perception of the legal system—both valuable outcomes that would not show up in the analysis below.100
Settle! Of course, given the unique obstacles involved with litigating against a pro se party—including the absence of the important buffer between the party and his or her emotions and, more times than not, unreasonable expectations—the key to trial success may be avoiding trial altogether! To that end, early alternative dispute resolution proceedings can be exceedingly beneficial. A neutral third party can often insert reasonableness otherwise lacking into the pro se party’s view of the strengths and weaknesses of the case.
The Sixth Amendment guarantees criminal defendants the right to representation by counsel.  In 1975, the Supreme Court held that the structure of the Sixth Amendment necessarily implies that a defendant in a state criminal trial has a constitutional right to proceed without counsel when he voluntarily and intelligently elects to do so. See Faretta v. California, 422 U.S. 806 (1975).  Thus, an unwilling defendant may not be compelled by the State to accept the assistance of a lawyer.  A defendant's right to self-represenatation in federal criminal proceedings is codified in 28 U.S.C. § 1654. 
Local Rule 54.3, Award of Attorney Fees, states that "attorney fees will not be treated as routine items of costs. Attorney fees will only be allowed upon an order of a judge of the court after such fact finding process as the judge shall order." Rule 54.3 sets out the requirements for petitioning the court for an award of award fees; and after the petition is filed by the prevailing party, the other party has fourteen days to object to the award.

Prior to the actual trial, a pretrial conference is usually held between the trial judge and counsel to determine if all discovery has been completed, what exhibits and witnesses each side might use during the trial, the approximate length of time that will be necessary for the trial, and what ground rules the judge will require before, during, and after the trial. After the conference, a pretrial order is usually prepared which sets out the above.

Serve The Complaint.  Once a complaint is filed, it must be served on all defendants. Usually, a plaintiff will pay a registered process server to personally serve the defendant. Follow your state or federal rules precisely. One of the most common ways for a plaintiff, especially a  pro se  (federal court) or  pro per  (state court) litigant, to have his or her case dismissed is because of inadequate service.


128. However, this result is not robust against a different choice of years. For example, while the point estimate is still negative, the 95 percent confidence interval for a regression run on data from 1999 through 2006 includes zero (though the 90 percent confidence interval does not). Thus, the better takeaway at this point is not that the reform has had a negative impact on win rates but that it has not had a significant positive impact on win rates.
However, this book cannot serve as a complete guide to all the rules you need to know. For one thing, the exact rule in your court system may be somewhat different from the example we give. In that event, knowing about another similar rule—either a federal rule or another state’s rule—can help you locate the rule in your state. (See Chapter 23 for information on doing your own legal ­research.) Also, each court system has its own procedural rules that, though important, cannot be covered in this book. For example, local court rules set time limits for filing various kinds of documents and page limits on the length of those documents. You will have to learn and comply with these local requirements.

attorney-client relationship—whereas approximately two-thirds retained their units after receiving both unbundled legal assistance and representation by counsel.58 Overall, though the body of evidence is still limited, the empirical evidence suggests that providing lawyers for pro se litigants substantially improves case outcomes for those litigants. Critically, this implies that providing adequate access to counsel may substantially improve case outcomes for a meaningful percentage of pro se litigants.59
As mentioned, the decision to proceed as a pro se defendant will almost always be more risky than working with a lawyer. If you represent yourself, your success will depend on your own knowledge of the law and whether you can argue your claim in the proper way. At the very least you may wish to request an initial consultation with a criminal lawyer to determine what type of representation best suits your situation. You should not take any chances at all if you are unsure about your own abilities.      
109. It is worth noting that these reforms could produce unobservable benefits in a number of ways. For example, as discussed previously, some district courts may be implementing these reforms differently in practice, and it may be the case that a few are successfully implementing the reforms, resulting in significant improvements to case outcomes for those courts but not enough improvement to show up in the overall numbers. Alternately, it may be the case that one particular combination of reforms is especially impactful. There is not enough data to fruitfully study all permutations of reforms. Still, this analysis is revealing with respect to the cumulative effects of these reforms.
Some courts issue orders against self representation in civil cases. A court enjoined a former attorney from suing the new lover of her former attorney.[29] The Superior Court of Bergen New Jersey also issued an order against pro se litigation based on a number of lawsuits that were dismissed and a failure to provide income tax returns in case sanctions might issue.[30] The Superior Court of New Jersey issued an order prohibiting a litigant from filing new lawsuits.[31] The Third Circuit however ruled that a restriction on pro se litigation went too far and that it could not be enforced if a litigant certified that he has new claims that were never before disposed of on the merits.[32] The 10th Circuit ruled that before imposing filing restrictions, a district court must set forth examples of abusive filings and that if the district court did not do so, the filing restrictions must be vacated.[33] The District of Columbia Court of Appeals wrote that "private individuals have 'a constitutional right of access to the courts',[34] that is, the 'right to sue and defend in the courts'."[35]
