Some federal courts of appeals allow unrepresented litigants to argue orally (even so nonargument disposition is still possible), and in all courts the percentage of cases in which argument occurs is higher for counseled cases. In 2013, the U.S. Supreme Court adopted a rule that all persons arguing orally must be attorneys, although the Supreme Court claims it was simply codifying a "long-standing practice of the court." The last non-attorney to argue orally before the Supreme Court was Sam Sloan in 1978.

This Part focuses on an extensive set of pro se reforms made in the federal district court in EDNY. Because these reforms were publicly announced around the time of their implementation, this Part conducts a difference-in-differences analysis of these reforms to complement the differences analysis from Part III.116 This analysis strengthens the results in Part III, suggesting that pro se reforms have not impacted case outcomes for pro se litigants.
The clinic has also introduced a unique program that solicits junior lawyers at firms to take or defend depositions for pro se litigants on a pro bono basis. As a former litigator in private practice Tarnofsky recognized that in high stakes litigation, clients often want experienced lawyers handling depositions. This program has been welcomed by a number of large New York City law firms an opportunity to train the next generation of lawyers. For pro se litigants it means not having to face a tough deposition on their own, and having a far better chance to tell their stories and make the best case or mount the best defense possible.
Court clerks withhold information from non-lawyers that they routinely give to lawyers. If a lawyer's office calls to ask about a particular scheduling procedure, for example, the clerk provides all sorts of answers without thinking twice. But let a self-represented person ask for the same (or even much less) information, and it suddenly becomes legal advice. Many clerks' offices feel compelled to post signs saying, "We don't provide legal advice!" Most often, that means that they are unwilling to help unrepresented people get into court or respond to a lawsuit. (Imagine if IRS clerks refused to answer questions about how to file a tax return.)
THE mother from North Haven sat in the back of Judge Patricia L. Harleston's wood-paneled courtroom at the New Haven County Courthouse and cried quietly. She was unemployed, she owed more than $2,000 in child support and she had no idea how she was going to defend herself. She said she couldn't afford a lawyer, so she was representing herself at the child support hearing. Meanwhile, the lawyer for the father of her children sat across the room.
Oh my Lord Sonja, you’re my new hero! I went at it with an attorney on Avvo; I asked a legal question and he more or less belittled me for thinking that I had a case and then for thinking that I could actually handle it on my own. This guy was a real jerk! l know I have a winning case but there are not many lawyers in my area that are familiar enough with the statutes to take it pro bono and therefore take the risk. Even the legal opinions that I’ve read say the case law is sparse. Thank you for standing up for pro se litigants and setting the record straight.
It's an uphill climb! Particularly, when your adversary has a thorough understanding of the rules of evidence, and procedure. You may get some latitude from the court as a pro se, but you may not, as it is up to the judge. Either way, the better question is why don't you have a lawyer on your side? Is it because some lawyers have not seen enough strength in the facts and law in your case? If that's the case, then you have an even steeper climb as you have a difficult case to prove, let alone that it's against a seasoned "high profile" lawyer. If you haven't consulted with an attorney, please do so before you do anything further as a pro se, and perhaps jeopardize your claim irreparably.
If you want to appeal the denial of some benefit that is provided through an agency of the United States government or the state of Idaho, you must pursue all of the administrative procedures which are set up by the agency before you can bring a lawsuit. Only after you have pursued and exhausted the administrative procedure will the court have jurisdiction to hear a claim.
Know the Rules of the Road. Before filing a lawsuit, you must carefully read your state’s code of civil procedure and the court’s local rules. If you also have federal claims and wish to file in federal court, then you must read the Federal Rules of Civil Procedure, as well as the particular district’s local rules. In addition, some judges have their own rules called local local rules. You must familiarize yourself with these rules as well.
But that shouldn't make a difference, as all cases are to be judged on their merits, not by the persons who bring them. By law, every federal judge must take an oath affirming to "administer justice without respect to person, and do equal right to the poor and to the rich," and to "faithfully and impartially discharge and perform all the duties incumbent upon me as judge under the Constitution and laws of the United States."
Jurisdiction is the authority given a court to hear and decide certain cases. For a court to render a valid judgment, it must have both jurisdiction over the subject matter of the controversy and jurisdiction over the persons or entities involved. The court system is described more fully in Chapter IV of this handbook; however, to file a case in federal court, you must meet at least one of two important criteria:
Arbitration is an alternative to trial that is often perceived to be quicker and less costly. In arbitration, a privately agreed-to arbitrator, not a judge, rules on the case. There is no jury, procedures before the hearing are more informal, and the arbitrator is not strictly bound by rules of evidence. Arbitrators generally charge by either the full or half day; you and your adversary split the arbitrator’s fee.

Importantly, this Comment does not suggest that these reforms have been failures. These reforms may have improved the pro se litigation process by making it feel more humane and easier to understand and by giving litigants a stronger sense that their concerns have been heard. Moreover, these reforms may still ease the burden of pro se litigation on courts by helping courts understand the issues involved more clearly or by moving cases through the judicial system more quickly. The analysis does suggest, however, that district court reforms have been ineffective in improving case outcomes for pro se litigants, and alternative approaches should be considered.
Many states have amended their court procedures to make litigation less of a challenge for self-represented parties. For example, the New York State Courts’ “eTrack System” allows civil litigants to file court papers electronically, sign up for free reminders about court appearances, and receive e-mail notifications whenever a court updates their case file. New York has also established a website that contains information about legal procedures, a glossary and court forms. Visit www.nycourthelp.gov.
But a person who is not a professional lawyer typically lacks ready access to Lexis, WestLaw, and other such professional resources for researching recent and applicable case law. (Let us assume that the Bar does not exist in principle as a barrier to citizens seeking redress of grievances through the judicial system. I.e., "That's what lawyers are for, so pay up if you want justice" may be the practical answer. But I want to know how practical it is for one to seek justice pro se.)
Let’s say you go to court and a court reporter is not present. You argue very strong points against an attorney with weak ones. Despite both the law and facts on your side, you lose. Think an appellate court will understand what went wrong and overturn the ruling? Probably not. Appellate courts will find many excuses not to overturn a lower court ruling. Without a court reporter’s transcript, an appellate court will say that the lower court was in the best position to evaluate the arguments made. Then, they’ll let the lower court decision stand. A court reporter, on the other hand, creates an official record of proceedings that can be sent to the appellate court. In the lower court, the simple presence of a court reporter greatly curtails judicial bias and bad behavior from lawyers. With that, you have a better chance of getting a fair hearing. What is a Pro Se Complaint? This is, quite simply, a lawsuit that a person files without a lawyer. The ADA Pro Se must be filed in Federal District Court., because the ADA is a Federal law. To find out which US District Court you will be filing your complaint in, look in the phone book blue (or green) pages, under United States Government Offices, "U.S. Courts".
A fellow advocate member of DAC, our advocacy group, filed her Pro Se in Federal District Court, after waiting and waiting for DOJ to respond. She lives on a low fixed income, and was able to waive the filing fee. Within a week, she received her notification of receipt that her case is now pending in federal court. At the same time she received notification that the inaccessible business was being served the complaint by a federal marshal. Shortly after that, she received a letter from the attorney for the inaccessible business stating that they wanted to settle out of court. Of course!! We settled for full compliance with the ADA.
