Great advice! Every point you have made about lawyers and their tricks, I have experienced. One of the greatest failures of the lower courts is the acceptance of inadequate documentation because they go unchallenged. The court is not going to do your work or come to your rescue as you may think. If the document is a not original or is forged, it is up to you to make the case. Even if the judge can see that a document may have an obvious forgery, you must still make the case against it.


1. If you don't know where your federal court is, look under "U.S. Government Offices ‹ U.S. Courts" in the blue or green pages of your phone book. When you find out which district court is yours, add it at the top of your pro se where it reads, "in the United States District Court for the [ ] district of [your state]." Don't worry yet about the Civil Action No. The clerk will give that to you at your district court office.

If the case is not dismissed via summary judgment, defense counsel should always request a pretrial conference with the court. That way the pro se plaintiff can hear from the judge, before everyone is in the courtroom, what evidence may or may not be addressed during the trial, and what the expectations will be of the pro se plaintiff’s behavior during the trial.

102. The types of cases that typically result in final judgment, and are evaluated here, are cases that are disposed of following judgment on default, consent, motion before trial, jury verdict, directed verdict, court trial, arbitral award, or other resolution. Cases disposed of via transfer or remand or dismissed due to settlement, voluntary dismissal, lack of jurisdiction, or want of prosecution are discarded in this analysis.


Administrative hearings rather than trials typically result when individuals contest decisions made by government agencies, or when government agencies refuse to act favorably on individuals’ requests. Thanks in part to movies and TV, a popular notion is that in the U.S., trials are the most common method of resolving civil disputes. In fact, across the country many more administrative hearings than trials occur.
Some districts of the United States Federal Courts (e.g., the Central District of California) permit pro se litigants to receive documents electronically by an Electronic Filing Account (ECF), but only members of the bar are allowed to file documents electronically.[12][13] Other districts (e.g. the Northern District of Florida) permit "pro se" litigants to file and receive their documents electronically by following the same local requirements as licensed attorneys for PACER NEXT GEN qualifications and approval for electronic use in particular cases; an order of the assigned Judge on a pro se motion showing pro se's qualifications may be required.[14]

This notion is particularly crucial when defense counsel files a motion for summary judgment. The court will be less tolerant of a pro se plaintiff’s pleading deficiencies if the plaintiff was made aware of the complexities involved in responding to a summary judgment motion. In fact, the pro se plaintiff will have been alerted that perhaps they should engage counsel at this point in their case, and failure to do so may not serve their best interests.
Trial attorneys who are not mindful of the psychological and sociological elements at play when litigating against pro se parties risk exacerbating an already difficult situation by increasing the likelihood of protracted and unfocused litigation, appealable procedural missteps, and unmanaged expectations. Thus, at the outset of the lawsuit, an attorney facing a pro se opponent should make every effort to determine what is motivating the litigation (e.g., hurt feelings, anger, unmitigated expectations) and, if possible, the reason for the lack of representation. Throughout the pretrial process and during trial, a primary objective of counsel should be to strategically allow the pro se litigant to air his or her grievances in such a way as to limit the scope of triable issues while still being satisfied with his or her day in court.
So even if it seems highly unfair, do not be surprised if you encounter initial hostility from court personnel. In your eyes, you are an individual seeking justice and doing what you have a right to do. But to the people who work in courthouses every day, you may be perceived as someone who will make their jobs more difficult. Instead of helping you, they may even attempt to put obstacles in your path, hoping that you will get discouraged and go away.
I’ve filed and served a request for admissions which the Defendant”s attorney failed to answer within the 30 day period allotted by rule here in Oregon. The rules also state that a failure to answer the request will result in admission of the answers requested. From what I can glean from the rules, I now need to file a “Motion To Determine Sufficiency”. If I fail to file such a motion, can I simply ask the court to declare, at the outset of trial, that the defendant, by failing to answer the admissions request, has in fact admitted certain facts which I no longer must prove at trial?
In one study, researchers identified almost 200 discrete tasks that self-represented litigants must perform in civil cases – from finding the right court to interpreting the law, filing motions, compiling evidence and negotiating a settlement. Some of these tasks require specialized knowledge of the law and of the court system. Almost all require time away from work and caring for children. Many also require the ability to get to the courthouse, to read and to speak English or access a translator.

The court said, in reversing the lower court’s dismissal of the plaintiff’s pro se discrimination claim, that the exception to the requirement of making the plaintiff state all discrimination claims at the EEOC level, i.e., allowing reasonably related unstated claims to be brought in the federal court, “is essentially an allowance of loose pleading and is based on the recognition that EEOC charges frequently are filled out by employees without the benefit of counsel and that their primary purpose is to alert the EEOC to the discrimination that a plaintiff claims [he or she] is suffering.” Id. at 201.


109. It is worth noting that these reforms could produce unobservable benefits in a number of ways. For example, as discussed previously, some district courts may be implementing these reforms differently in practice, and it may be the case that a few are successfully implementing the reforms, resulting in significant improvements to case outcomes for those courts but not enough improvement to show up in the overall numbers. Alternately, it may be the case that one particular combination of reforms is especially impactful. There is not enough data to fruitfully study all permutations of reforms. Still, this analysis is revealing with respect to the cumulative effects of these reforms.
The Sixth Amendment guarantees criminal defendants the right to representation by counsel.  In 1975, the Supreme Court held that the structure of the Sixth Amendment necessarily implies that a defendant in a state criminal trial has a constitutional right to proceed without counsel when he voluntarily and intelligently elects to do so. See Faretta v. California, 422 U.S. 806 (1975).  Thus, an unwilling defendant may not be compelled by the State to accept the assistance of a lawyer.  A defendant's right to self-represenatation in federal criminal proceedings is codified in 28 U.S.C. § 1654. 
Narrow exceptions to this principle have also been suggested by other courts in the United States. For example, according to one district court a state-licensed attorney who is acting as pro se may collect attorney's fees when he represents a class (of which he is a member) in a class action lawsuit,[53] or according to another court represents a law firm of which he is a member.[54] In each of those instances, a non-attorney would be barred from conducting the representation altogether. One district court found that this policy does not prevent a pro se attorney from recovering fees paid for consultations with outside counsel.[55] Pro se who are not state-licensed attorneys cannot bring up a class action lawsuit.[22]
Attempts by defense counsel to rationally contend with pro se plaintiffs can be frustrating and emotionally taxing. Many employers and in-house counsel see pro se plaintiffs as less of a legal threat, and have difficulty in understanding why defense counsel simply cannot “make this problem go away” without spending a great deal of billable time on the matter.
Accordingly, this Comment suggests that pro se trial court reform is not the silver bullet that some commentators have hoped for in the quest to remedy the shortcomings of the pro se litigation process. In order to meaningfully improve case outcomes for pro se litigants, the legal community will either need to implement different and potentially more dramatic reforms than those implemented thus far or consider another approach altogether, such as renewed advocacy for “civil Gideon.”12 Alternatively, it is also possible that there is no cost-effective way to improve case outcomes for civil pro se litigants in the context of the modern US legal system. This Comment does not analyze the merits of these options. Instead, it strongly suggests that a different solution is needed to ensure pro se litigants get a full and equal opportunity to have their claims redressed via litigation.
The primary dataset used in this Comment consists of administrative records of civil cases filed in federal district courts, which are collected and published by the Administrative Office of the United States Courts (AO).76 The AO dataset includes the district court in which the case was filed, the docket number of each case, the date on which the case was filed, the nature of the suit, the procedural progress of the case at the time the case was disposed of, the manner in which the case was disposed of, the party that the final judgment of the case was in favor of, and whether the plaintiff or the defendant was a pro se party.77

A tort is defined as a "private or civil wrong or injury." It is distinguished from criminal law because it is an injury against an individual and not the state (city, county, or state government). If a person ran a stoplight and hit your car, the state would ticket the driver for running the stoplight but it would not be able to sue the driver for the injuries received by the victim of the other car. That is considered a private wrong or injury and it is the right of the victim to file a civil suit against the driver seeking damages for the injuries received.
There is limited Supreme Court jurisprudence on trial-court reforms for civil pro se litigants. However, an extensive body of case law establishes the right to counsel for indigent criminal litigants and then denies that right to civil litigants who cannot afford counsel. Moreover, in one recent case, Turner v Rogers,13 the Supreme Court established a limited right to procedural protections for civil pro se litigants, creating the potential for new jurisprudence establishing new rights for civil pro se litigants.14
We often talk to parents about whether to file for child custody pro se, a legal term also known as 'self-representation.' In general, we recommend that parents proceed with caution when it comes to filing for child custody or child support pro se. The following questions and tips can help you determine the best course of action related to your case.

Commentators have seen Turner as a complete rejection of civil Gideon, effectively foreclosing the possibility of an expanded right to counsel in civil litigation, at least for the foreseeable future.44 However, commentators have also seen the holding in Turner—that due process requires trial courts to protect pro se litigants’ rights via procedural safeguards—as a nod toward a new and potentially more fruitful approach to pro se litigation: reforms in trial courts.45

This way, you'll remember the strokes of genius that fleetingly pass through, and you'll be able to look back on them and remind yourself of the little things when you're feeling down.
The challenges presented by the large volume of pro se cases in federal district courts may require meaningful changes to achieve a full resolution. In order to make headway on that front, reformers must properly contextualize and understand the nature of pro se litigation in those courts and evaluate the successes and failures of efforts that have been undertaken thus far.
The Legal Services Corporation 2009 report, Documenting the Justice Gap in America, confirms an increase in the number of civil pro se litigants. Due to a lack of government funding, few low-income people can address their legal needs with the assistance of an attorney. As a result, state courts are flooded with unrepresented litigants. To close the gap between the number of people who don’t have access to legal help and those that are lucky enough to work with a legal aid office, the report calls for increased legal aid funding from federal and state governments and private funders and recommends that lawyers contribute additional pro bono services. These developments may be spurred by the U.S. Supreme Court decision in Turner v. Rogers (2012), which suggested that civil court proceedings have to be fundamentally fair, that courts should create forms to help pro se litigants participate fully in the justice system, and hinted that at least in some civil cases, the government may have to provide free legal assistance to parties who cannot afford to hire a lawyer.

But that shouldn't make a difference, as all cases are to be judged on their merits, not by the persons who bring them. By law, every federal judge must take an oath affirming to "administer justice without respect to person, and do equal right to the poor and to the rich," and to "faithfully and impartially discharge and perform all the duties incumbent upon me as judge under the Constitution and laws of the United States."

 A. Your initial court date will  be  shown as the "Trial Date" near the top  of the complaint. If the defendant is not served with summons, the Judge will cause another summons (called an "alias summons") to be issued; a new  "Return Date", and a  new trial date will be shown on the complaint.  You are required to appear in court on the trial date even if you know the defendant was not served with summons, but you need  not bring your  witnesses. Your appearance is required so that  you may proceed with renewed efforts to serve the  summons.
Hourly rates for lawyers who do personal legal-services work typically run from $100 to $250 per hour. Certain experts and big-firm lawyers charge even more. It is important to find out exactly how the lawyer will calculate the bill. For example, some lawyers who charge by the hour bill in minimum increments of 15 minutes (quarter hour), and others bill in increments of six minutes (tenth of an hour). That means that a five-minute phone conversation for which you are billed the minimum amount could cost you different amounts, depending on how the lawyer figures the bill.
Unfortunately, the ideal of the multi-door courthouse is at odds with how courts traditionally operate: to support and enhance the lawyer business by making it extremely difficult to get through court without a lawyer. As long as courts are institutionally biased against creating a level playing field for the self-represented, it will make no difference how many doors a court has.
The judge in my case offered an angry and dismissive "Here we go!" when I argued that he must liberally construe the allegations in my complaint, as the 1972 Supreme Court precedent Haines v. Kerner dictates. He also disregarded the court's own local rules by denying my right to conduct my own voir dire of the prospective jurors, simply because I was proceeding pro se. He berated me in open court for my refusal to retain an attorney, and condescendingly informed me that he didn't think I would prevail at the trial. At various points, including when he urged me to accept the defendant's settlement offer, I felt he was trying to intimidate me simply because I chose to represent myself.
As the plausibility of civil Gideon has diminished in the wake of Turner, trial court reforms for pro se litigants have emerged as a compromise. Both proponents and critics of civil Gideon see major potential benefits of pro se reform: it is a low-cost option that could conceivably provide meaningful benefits to pro se litigants without diverting legal resources from more critical cases, it helps ensure pro se litigants will receive fundamentally fair hearings, and it is a more politically and jurisprudentially feasible solution than civil Gideon.60

The lack of civility among lawyers is a frequent topic at bar association meetings. Canon 7 of the American Bar Association Model Code states that a “lawyer should represent a client zealously within the bounds of the law.” Many lawyers blame an over-enthusiastic reliance on Canon 7 for what they consider a rising tide of lawyer incivility (or bullying) that characterizes modern litigation. Basically, what I'm saying is, the assumption in your second paragraph--that civil rights law is something you can teach yourself by reading other people's pleadings and filings--is false. There are people who study the law for three years, and still aren't considered competent enough to be licensed. You are not going to pick it up in a week or two.
Now most pro se litigants are at a disadvantage in contested litigation. It may be awkward or inappropriate for them to appear both as counsel and as a witness. They're deprived of the judgment of an independent third party in framing the case, in evaluating how to present the evidence and in forming legal arguments and also in making sure that it is reason rather than emotion that steers how the case is conducted. That's why Judges sometimes warn a party who is proceeding pro se of the old saying that anyone who represents himself in court has a fool for a client and an ass for an attorney.
Whatever your case is about, I can't emphasize enough for you to take a morning off from work to go watch some cases in court. You'll eliminate some fear of the unknown, you'll start to see that attorneys go through a similar set of procedures that you are just as capable of performing yourself, and you'll get a feel for how to talk to the judge and those who might be in the same room as you.

If you go by calls and emails Jurisdictionary receives, there's good reason for this! Lawyers who bail at the last minute. Lawyers who don't know what they're doing. And, worst of all, lawyers wishing to curry favor with judges, afraid to stand up to the buffalo in the black robe and demand their clients' rights by making timely objections and threatening appeal.
Comment—appear to have no more than a 1 percent impact on the percent of pro se litigants that actually win cases in court. Perhaps more likely, they do not actually impact case outcomes at all, and the 1 percent variation is simply noise. Regardless of whether they account for some small improvement, however, these results show that pro se reforms are not significantly moving the needle in terms of case outcomes. Any potential improvement is substantially smaller than what the experimental literature suggests would result from improved access to counsel.112 Hence, compared to pro se win rates with a lawyer, these reforms cannot be considered a meaningful substitute for access to counsel even if they yield a small improvement, at least insofar as the goal is to help pro se litigants win more cases.
Even though mediation is informal, to reach a successful result you will need to show your adversary that you have strong evidence to support your legal position—evidence that is admissible in court should mediation fail. Otherwise, your adversary may not be willing to settle the case on terms you think are fair. This book will help you represent your position effectively during mediation.
What is a Pro Se Complaint? This is, quite simply, a lawsuit that a person files without a lawyer. The ADA Pro Se must be filed in Federal District Court., because the ADA is a Federal law. To find out which US District Court you will be filing your complaint in, look in the phone book blue (or green) pages, under United States Government Offices, "U.S. Courts".
