2. Motion for Instructed or Directed Verdict: This motion is usually made by the defendant at the close of evidence presented by the plaintiff’s side and is based on the premise that the plaintiff has failed to prove his case. If it is granted, the court instructs the jury to render a verdict for the defendant and against the plaintiff, and the trial is concluded in the defendant’s favor. If the court denies the motion, the trial continues with presentation of the defendant’s side.

Department of Social Services,37 the appellant argued that failing to provide counsel in a civil suit that would terminate parental rights violated the Due Process Clause.38 A 5–4 majority on the Supreme Court held that there was no general right to appointment of counsel in parental termination proceedings despite the importance of the right involved. The Court explained that a

Tables 2E and 2F, the final tables in this Part, examine how win rates for pro se litigants vary across different types of cases. The win ratios in Table 2E compare the probability of a plaintiff winning when both parties are represented to the probability of a plaintiff winning when the plaintiff is a pro se plaintiff but the defendant is represented. In the column “Plaint Rep’d / Plaint Pro Se,” the number 2.0 would mean that plaintiffs win twice as often when both parties are represented as compared to cases in which the plaintiff is pro se. The higher the number, the better represented litigants fare relative to pro se litigants.

Even common criminal charges like burglary can be complicated because there are many elements to prove. Also, in any criminal trial, there are many procedural rules that must be followed in court, such as how to make objections and how to enter evidence. Procedural rules can be difficult to learn on the spot, especially if the defendant is in the custody of the court.


If the parties have not requested a trial by jury, Local Rule 38.1, the judge becomes the trier of law (the judge) and the trier of fact (the jury). The judge then enters a Findings of Fact and Conclusions of Law, sometimes prepared by the prevailing party, based on the evidence and arguments presented and then a judgment is entered based on those findings of fact and conclusions of law.

The potential relevance of selection bias in this analysis should also be addressed. As Part II discusses, selection bias can likely explain a portion of the gap in case outcomes between pro se and represented litigants.110 However, as this Part discusses, the relevant sample for comparison is the difference in case outcomes between pro se litigants in courts that have implemented reforms and courts that have not implemented reforms. Thus, the pro se cases in different district courts are similarly affected by this selection bias. Litigants with weaker cases may be more likely to proceed pro se in EDNY, but they are also more likely to proceed pro se in the Southern District of New York (SDNY) or the Northern District of Illinois. Accordingly, the cases being compared should presumably be similar in average strength, or at least there is no reason to think this selection bias will result in differences in average case strength for pro se litigants across different district courts. These selection bias issues result in a gap in the average strength of cases brought by pro se litigants and represented litigants, but they do not lead to a gap between the average strength of cases brought by pro se litigants in two different district courts.111

If you have a paragraph 18 and 19, then you might want to add a paragraph 20 that might read something like this, "Other commercial facilities similar to the defendant's have made similar modifications, like what we ask here. Defendant could easily make his business accessible but has chosen not to comply with the Americans with Disabilities Act." You might also want to add a 20a that reads, "to assist businesses with complying with the ADA, Congress has enacted a tax credit for small businesses, and a tax deduction available to all businesses."
While the outcome gap between pro se and represented litigants does not necessarily prove that lack of access to counsel causes poor case outcomes for pro se litigants, it is easy to see how it motivates proponents of pro se court reforms or civil Gideon. Table 2C suggests that, whenever one of the parties is proceeding pro se, the likelihood that any final judgment will be registered for the other party is overwhelming. If one believes that a meaningful portion of pro se litigants have important rights that they are seeking to vindicate in court, it is likely they are not receiving adequate remedies under the current legal system.85
7. At least some commentators have expressed concern that allocating more legal resources to pro se civil litigants might take away from resources needed for indigent criminal defense. See Barton and Bibas, 160 U Pa L Rev at 980–81 (cited in note 5). It is important, however, to recognize that legal resources also may trade off with nonlegal resources, and an analysis accounting for these trade-offs may make the economics of expanded legal resources for pro se litigants look more attractive. Additional money spent on lawyers or pro se assistance might be more economical than it first appears if, for example, additional state spending in an eviction or wrongful termination proceeding saves the government from paying for homeless shelters or welfare assistance at a later date.
Administrative law judges (often called “ALJs”) preside over administrative hearings. ALJs are typically appointed based on their expertise concerning the work of a ­particular agency. Most ALJs are not in fact judges; some may not even be lawyers. Moreover, administrative hearings typically take place in small officelike hearing rooms rather than in courtrooms, and no juries are present. Usually, indiv­iduals ­involved in administrative hearings represent them­selves. However, whereas only lawyers can represent people in court, agency rules usually allow nonlawyers called “lay ­representatives” to appear on behalf of individuals in administrative agency hearings. If you will participate in an admin­istrative hearing, you may want to prepare for it by at least conferring with a lay representative before the hearing takes place.
Use small claims court techniques in bench trials. Most states have revamped court rules and procedures to accommodate non-lawyers very well in one place: their small claims courts. Small claims cases are not simple; many are conceptually difficult. (Lawyers have been willing to accommodate the small claims court system because those cases present little or no potential for fees.)
Following the entry of the jury’s verdict, either side may give notice of its intention to appeal. The judgment is prepared by the prevailing side and presented to the court for entry. These post-trial motions usually set out why the jury’s verdict should be disregarded or why the judgment submitted by the other side should be more in keeping with the jury’s verdict. Local Rule 58.1.
Of course a pro se litigant can prevail. The Judges, particularly in the family part, routinely have pro se litigants appear before them. The Judge does not determine matters based upon who has an attorney and who does not. The Judge determines matters based upon the facts and proofs presented. Some pro se litigants can be very effective and others are not. If you are not comfortable or need guidance as to what should/should not be included/presented, you would be wise to consult with an attorney with expertise in that area of law.

The SDNY, which provides the funding for the clinic, recently approved the introduction of a mediation project, which in a short period of time has proved to be highly effective. Clinic staff members and volunteers are now permitted to represent pro se litigants in connection with settlements.  Litigants get an impartial view of the strengths and weaknesses of their cases, resulting in earlier resolutions. Over half of the litigants who were represented by clinic staff members or volunteers settled their cases.
This Comment furthers the legal community’s understanding of issues in pro se litigation by conducting an empirical analysis of pro se reforms in federal district courts. By comparing case outcomes for pro se litigants in district courts that have implemented these types of reforms with the outcomes of similarly situated pro se litigants in courts that have not implemented any reforms, this Comment provides an initial assessment of the impact of those reforms. The analysis reveals that thus far, a wide range of reforms undertaken by federal district courts have not significantly impacted case outcomes for pro se litigants. This analysis conflicts with the intuitions of the Supreme Court, commentators, and judges and clerks of district court offices, who have indicated their belief that these reforms are effective.
Though arbitration proceedings are generally less formal than trials, most of the principles ­described in this book also apply to arbitration. As in a trial, you and your adversary present evidence to the arbitrator through your own testimony and the testimony of witnesses. Like a judge, an arbitrator evaluates the credibility and legal significance of evidence to decide whether you win or lose the case.

Let the pro se party’s voice be heard. Individuals representing themselves at trial in civil litigation are often battling hardships on many fronts. Generally, they have found themselves in an unfamiliar and intimidating setting governed by a labyrinth of substantive and procedural rules, along with unwritten local customs and expectations. This maze can be challenging for even the most tested trial attorney. It is particularly daunting to pro se parties. Of course, it is frequently not by choice that pro se parties are in trial without the benefit of legal counsel. Whether they are acting as a plaintiff or a defendant, their status as a pro se party is many times forced by precarious financial situations. Moreover, the types of lawsuits in which pro se litigants are regularly involved—employment, professional malpractice, personal injury, whistleblower cases, and collections, to name a few—are often particularly rife with emotion and typically involve allegations of a sensitive, personal, and sometimes embarrassing nature. Indeed, these cases are often plagued by feelings of anger, resentment, pride, shame, and revenge. To make the situation even more challenging, pro se litigants frequently take the drastic step of representing themselves in civil litigation because they view themselves as victims of a wrong that must be made right, and they do not view as primary considerations the time and costs associated with redressing the wrong.
A pro se litigant is an individual who is representing himself in a civil court action. While the law allows nearly anyone to be a pro se litigant, and to appear in court on their own behalf, there are some limitations. For example, a pro se litigant, or self-represented litigant, cannot represent others. This places certain limitations on pro se representation, such as:

As time went on, other factors played a role in spurring the increase of pro se litigants. Shirley M. Pripstein, who practices family law with Greater Hartford Legal Aid, said federal budget cuts in the mid-1990's sapped agencies that provided free legal service to the poor. Legal aid lawyers began to concentrate on the most difficult cases, such as those involving domestic abuse. They didn't have time or resources for poor people involved in more-standard divorce cases.
Unless you are in court regularly, you may not know how a case proceeds from initial filing through trial. Therefore, this book also provides you with background information about what you will see—and what you need to do—when you enter the courtroom where your case will be heard. You will learn where to file your court papers; how to subpoena witnesses (order witnesses to come to court and testify); the functions of a courthouse Clerk’s Office and a courtroom clerk; and the powers and duties of all the personnel who typically carry out courthouse business, including bailiffs, court reporters, interpreters, attorneys, jurors, and judges.
There are several important limitations to using this data. First, the exact date of the survey is unclear and, relatedly, the exact dates that each district court responded that it was employing or not employing these procedures is uncertain. The analysis is conducted using cases filed between 2008 and 2010. Accordingly, if a large number of district courts altered their policies shortly before this survey was conducted or if the survey was conducted substantially before the survey was published, it’s possible that this analysis would undercount the effects of those policies. In either of those scenarios, the full consequences of these reforms might not be seen in the 2008–2010 data sample. However, there is no information suggesting that either possibility is reflected in reality. Courts and commentators have been discussing and attempting to solve the challenges of pro se litigation for decades and implementing reforms for at least a decade; it seems unlikely that they all started implementing these solutions immediately prior to the survey.96
Massachusetts District Court and Prospects for the Future, 126 Harv L Rev 901, 914 n 57 (2013) (discussing a recent American Bar Association (ABA) recommendation to provide pro bono counsel to civil litigants in cases involving “direct threats to the provisions of basic human needs, including shelter”). The ABA has also recommended appointed counsel for cases involving sustenance, safety, health, child custody, or removal proceedings, highlighting the breadth of potential “basic needs” that some advocates believe merit the appointment of counsel in civil pro se litigation. The clinic has also introduced a unique program that solicits junior lawyers at firms to take or defend depositions for pro se litigants on a pro bono basis. As a former litigator in private practice Tarnofsky recognized that in high stakes litigation, clients often want experienced lawyers handling depositions.  This program has been welcomed by a number of large New York City law firms an opportunity to train the next generation of lawyers. For pro se litigants it means not having to face a tough deposition on their own, and having a far better chance to tell their stories and make the best case or mount the best defense possible.
Additionally, there is no obvious way to test the consistency or validity of these survey results. If different courts implemented substantively different reforms but mapped them to the same policies when answering the questionnaire, these results may underestimate the effectiveness of certain policies. For example, if one district court allowed pro se litigants to conduct extremely formal and limited communications with pro se clerks, while another district court allowed pro se litigants who showed up at the court to receive extensive counseling from pro se clerks, both district courts may report that they provided “direct communications with pro se clerks.”99 These two policies may be sufficiently distinct that they have very different influences on the outcomes of pro se litigation. The available survey data does not provide a reliable way to tease out these types of distinctions, and they are grouped together in the analysis below. Similarly, if overburdened district courts were simply sloppy in their survey responses, this methodology may in turn underestimate the results of these policies.

If the jury or the judge awarded costs to the prevailing party, it is necessary to prepare a bill of costs incurred in the suit for the approval of the court. Costs are specified by Local Rule 54.1 as to what is allowable, and only those costs listed as allowable may be recovered by the prevailing party. Within fourteen (14) days after entry of judgment, under which the costs may be claimed, the prevailing party may serve and file a cost bill requesting taxation of costs itemized thereon.


C. If you are the plaintiff and do not appear on the trial date, the case will be dismissed unless you (or somebody else for you) appears toask the Court  for a continuance and the Judge grants the request (see paragraph 14). If the case is dismissed, you may file a motion within 30 days after the dismissal to reinstate the case and to have an immediate trial. Ms. Eldrich and others she knew through the New Haven women's movement vowed to change that. They published a book that taught people how to do their own divorces if the cases were simple, believing that it would empower people to get involved directly in the court system. And because women were often the ones to initiate the divorce, they considered the book a way to empower women particularly, said Diane Polan, one of the authors.

Do I have the time and resources available to represent myself pro se? As you can see, there is a lot of learn before representing yourself at a child custody hearing. Parents considering pro se representation should carefully consider whether they have the time, determination, and undivided attention necessary to dedicate to this task before deciding to go it alone in court. 
Unfortunately, the ideal of the multi-door courthouse is at odds with how courts traditionally operate: to support and enhance the lawyer business by making it extremely difficult to get through court without a lawyer. As long as courts are institutionally biased against creating a level playing field for the self-represented, it will make no difference how many doors a court has.

Every agency tends to make its own rules and follow its own unique set of procedures. Many agencies describe their procedures on a website. In addition, an agency will furnish you with its rules as soon as you indicate that you want to file a claim. Be sure to contact the agency, ask for a copy of its rules before initiating a hearing, and follow them. The federal government and every state have an Administrative Procedure Act that provides basic protections in administrative hearings. You should read the applicable law and make sure the agency follows it. You can get information about these laws from a convenient database maintained by Florida State University at www.law.fsu.edu/library/admin.

Some defendants are unwilling to pay and trying to collect requires time and patience. In seeking to collect,  plaintiff has a right to telephone the  defendant at reasonable times. A lawyer can get vehement, though, when he himself gets strangled by the judge. In Morris v. Schnoor, the appellant attorney is quoted as saying that "When the judiciary acts as the b_tch for complainant, we get rulings like this" (the appellate opinion reproduces the actual b-word). Just don't expect much boldness when a lawyer litigates your case.


When cases go to trial before a judge, there is no reason to insist on formal procedures or evidence rules. The judge should facilitate each side's presentation as is done in small claims court, rather than sit back and make the parties present their cases under arcane rules that take years to master. This approach would not violate due process, because judges would base their decisions on competent and relevant evidence.

If the case is not dismissed via summary judgment, defense counsel should always request a pretrial conference with the court. That way the pro se plaintiff can hear from the judge, before everyone is in the courtroom, what evidence may or may not be addressed during the trial, and what the expectations will be of the pro se plaintiff’s behavior during the trial.

Table 2D shows the most common types of litigation in federal district courts and the frequency with which each type of case involves a pro se plaintiff or defendant. Pro se plaintiffs bring a disproportionately large percent of civil rights and employment discrimination cases. In contrast, pro se plaintiffs rarely bring other types of cases, such as products liability, contract, asbestos, and insurance cases.86 Table 2D also shows that the only types of cases that frequently involve pro se defendants are property cases, which are primarily foreclosure proceedings.87 Perhaps the most important takeaway from Table 2D is that a substantial proportion of many types of cases are brought by pro se plaintiffs. Though there is significant variance—pro se litigants bring 32 percent of civil rights cases but bring a more modest 8 percent of cases involving the government and 2 percent of insurance and product liability cases—pro se litigants are prevalent across many types of cases. Any reforms targeting just one type of lawsuit cannot fully address the scope of issues faced by pro se litigants.


Unlike in the criminal context, there’s no federal constitutional right to counsel in civil cases. Civil cases can involve a range of critical issues, including housing, public benefits, child custody and domestic violence. And while some civil litigants may be entitled to counsel in certain jurisdictions, in most of these cases, people who cannot afford a lawyer will be forced to go it alone. Doing so may mean that they fail to make it through the process, have their case dismissed or lose what otherwise would have been a winning case.

The unauthorized reproduction or distribution of a copyrighted work is illegal. Criminal copyright infringement, including infringement without monetary gain, is investigated by the FBI and is punishable by fines and federal imprisonment. No portion of this course may be published, duplicated, shared, or used by anyone other than the currently registered subscriber.
You cannot sue someone because you believe or you have a feeling the person has violated your rights. You must have facts to support your lawsuit such as the time and place of the incident, witnesses who observed the behavior, and actual articles of evidence such as a gun or a police report or other documentary evidence. The burden of proof is on the plaintiff to win the case; and without factual evidence, the case cannot be won.

One part of that questionnaire focused on the procedural steps that clerks’ offices took to assist pro se litigants, either through programs and procedures or efforts to improve access to counsel. The survey asked about eighteen different services, programs, or procedures that at least some district courts have implemented to assist nonprisoner pro se litigants.94 The appendix to that survey describes which of the responding district courts had implemented those policies as of the survey date for fifteen of those eighteen policies.95

Put another way, the follow-up question might be, "Even if he can't get the attention of an advocacy lawyer (e.g., the police performed an illegal search, but not enough harm was done to move their needle; or perhaps the department otherwise hasn't attracted negative attention), are there warning signs that a pro se plaintiff can pick up on if he's listening carefully that will keep him out of trouble? Or is there really just too much experience needed to reliably make the right calls on critical decisions, so pro se litigation is inherently perilous?" – feetwet♦ May 28 '15 at 18:57
4. Objections: During the examination of a witness, one side may “object” to the questioning or testimony of a witness or presentation of evidence if the attorney feels the testimony or evidence about to be given should be excluded. If the objection is sustained by the judge, that particular testimony or evidence is excluded. If the objection is overruled by the judge, the testimony or evidence may be given. A ruling on an objection may be the basis for appeal; however, in order to preserve the right to appeal, a party must ask the court recorder that that portion of the trial--the question/evidence, the objection, and the ruling-- be transcribed in order to preserve the record for later appeal.
The center’s approach, known as “limited-scope legal assistance,” can fill an important void. Most federal courts devote substantial resources to pro se litigants, such as handbooks and staff time answering process questions, and pro se staff attorneys help judges process cases. But court staff may not give legal advice to litigants, and although private lawyers offer some volunteer assistance, they cannot meet demand.
 D. Before trial,  the parties may be given an opportunity to meet  with a mediator appointed by the Judge to resolve their case. Mediators are volunteers; they try to help parties reach a friendly agreement. They are  not judges and do not make decisions. If the dispute is not resolved in mediation, the parties will proceed to a trial, usually on the same day.
I can definitely use these services. I am a well respected but hated pro se litigant. Why do attorneys get upset or angry when you have a lot of court cases even though none or criminal? If more than one person does the same thing to you why can’t you take them all to court? What is too many lawsuits? Most important I’m working on plaintiff summary judgement which was due today. The BIGGEST mistake pro se litigants make is thinking they know more than they do, as a way of overcompensating for lack of confidence. False bravado can lead you into mistakes #2, #3, and #4 on this list and a whole lot more. You don’t bring a court reporter because you don’t feel you need one. You don’t do research because you don’t have time, and you think you know enough. You react to or challenge every lawyer trick because you believe, without any evidence, that it’s the best thing to do. You talk about admiralty law, not because you know anything about it or where it fits into your case, but because you heard someone talk about it. You file the wrong motions in the wrong situations. It’s important to know what you don’t know and act accordingly. Instead of talking about sovereign citizenship, talk about and use civil procedure. Rather than reacting to lawyer antics, judicial bias or a sense of unfairness, focus on your case. Learn it backwards and forwards, and then bring your court reporter. Her situation was far from unusual. Judges, lawyers and other court personnel said in interviews that an increasing number of people over the last few years have been representing themselves in family cases, which include divorces and child-support and paternity hearings. The judges and lawyers said most people are representing themselves because they can't afford lawyers. And since there is usually no guaranteed representation in Family Court, like in criminal cases, and legal aid groups don't have the staff to step in, these "pro se" litigants are being forced to go to court alone.

If the ALJ rules against you, you typically can appeal within the agency. If the agency’s decision is still unfavorable, you have “exhausted your administrative remedies” and can go to court and file a pleading asking a judge to overturn it. However, the judge who reviews the case will decide it based on the information you provided at the hearing. You won’t be able to present new evidence in court.

A resource of moderate value are the online law forums. There are well-meaning participants who clarified legal concepts for me. However, I say those forums are of moderate value because: - some individuals embrace a role of sarcastic jurors (example: when somebody asks "can I sue for XYZ?", those guys like to answer "sure, you can sue, but you would lose", and it just gets worse); - many replies don't go beyond "ask an attorney"; and - those forums are usually managed by attorney$, so they di$like when a non-attorney provides effective advice that disproves the "need" for lawyers; that's actually what got me banned from two such forums.

I cant tell you how often I have defended clients against a pro se litigant who think they just have the best case and then it blows apart like flour in a fan when you get into Court. Non-attorneys are held to the same standard as attorneys. Everyone in the world, even the judge would prefer that you retain counsel. The reason why is simple, your not a lawyer. If you have a case, I am sure that you will find an attorney to represent you.
The Legal Services Corporation, the single largest funder of civil legal aid for low-income Americans in the nation, reported in June that 86 percent of low-income Americans receive inadequate or no professional legal help for the civil legal problems they face. Here in Georgia, state courts heard more than 800,000 cases involving self-represented litigants in 2016 alone.
Although case outcomes do not encompass all relevant information in assessing the impact or value of pro se reforms, they are nonetheless an important metric to consider. Lawyers are supposed to help their clients win cases. Accordingly, the viability of pro se reform as a substitute for better access to counsel should hinge in large part on its effectiveness at helping pro se litigants win those cases. Moreover, case outcomes are the typical metric that commentators consider when measuring the value of access to counsel to pro se litigants.101 Hence, when evaluating the tradeoffs of expanding pro se reform against expanding access to counsel, case outcomes are one of the most natural and salient measures.

As time went on, other factors played a role in spurring the increase of pro se litigants. Shirley M. Pripstein, who practices family law with Greater Hartford Legal Aid, said federal budget cuts in the mid-1990's sapped agencies that provided free legal service to the poor. Legal aid lawyers began to concentrate on the most difficult cases, such as those involving domestic abuse. They didn't have time or resources for poor people involved in more-standard divorce cases.
If you want to appeal the denial of some benefit that is provided through an agency of the United States government or the state of Idaho, you must pursue all of the administrative procedures which are set up by the agency before you can bring a lawsuit. Only after you have pursued and exhausted the administrative procedure will the court have jurisdiction to hear a claim.
So even if it seems highly unfair, do not be surprised if you encounter initial hostility from court personnel. In your eyes, you are an individual seeking justice and doing what you have a right to do. But to the people who work in courthouses every day, you may be perceived as someone who will make their jobs more difficult. Instead of helping you, they may even attempt to put obstacles in your path, hoping that you will get discouraged and go away.

Against this background, it doesn’t normally make sense to interpret your adversary’s offer to “talk settlement” as a sign of weakness. Nor should you be reluctant to be the one to suggest a negotiated settlement. In fact, judges, arbitrators, and mediators routinely urge adversaries to explore settlement even if previous attempts have failed. It’s a wise person who never closes the door to a reasonable settlement.
One important takeaway from this Comment, related to the limitations described above, is the importance of additional studies into the effectiveness of other reform measures, especially reform measures undertaken in courts other than federal district courts. As previously mentioned, other courts throughout the country have experimented with ways to help pro se litigants.130 Although the particular reforms analyzed here appear to have been ineffective, other reforms undertaken by other courts might achieve better results. With sufficient empirical legwork, successful reforms can be identified, and other courts can learn from those successes. Although courts likely attempt to learn from each other’s practices, without empirical validation of these techniques, there’s a risk that the blind are leading the blind. More empirical studies could help show the way.
The State Bar of Georgia provided the number of lawyers by county in 2016. By combining this data with information from the Self Represented Litigation Network, available census data from the 2014 American Community Survey, 2015 statistics from the Federal Communications Commission, data from the Center for Neighborhood Technology, and 2016 information from the Georgia Legal Services Program (GLSP) and the Atlanta Legal Aid Society (ALAS), the map provides insight into attorney representation and other factors that impact access to justice throughout the state.
Laws and organizations charged with regulating judicial conduct may also affect pro se litigants. For example, The State of California Judicial Council has addressed through published materials the need of the Judiciary to act in the interests of fairness to self-represented litigants.[9] The California rules express a preference for resolution of every case on the merits, even if resolution requires excusing inadvertence by a pro se litigant that would otherwise result in a dismissal. The Judicial Council justifies this position based on the idea that "Judges are charged with ascertaining the truth, not just playing referee ... A lawsuit is not a game, where the party with the cleverest lawyer prevails regardless of the merits."[10] It suggests "the court should take whatever measures may be reasonable and necessary to insure a fair trial" and says "There is only one reported case in the U.S. finding a judge's specific accommodations have gone too far." The committee notes to the Federal Rules of Civil Procedure rule 56 on summary judgments notes that "Many courts take extra care with pro se litigants, advising them of the need to respond and the risk of losing by summary judgment if an adequate response is not filed. And the court may seek to reassure itself by some examination of the record before granting summary judgment against a pro se litigant."[11]
