But this passage reminds us of the continuing tradition of morning dress for the Solicitor General’s office before the Supreme Court. If it already looked stupid in 1948, it definitely looks stupid now. Adhering to tradition for the mere sake of tradition is small-minded. After Elena Kagan dumped the practice — since wearing what is essentially a tuxedo is less than flattering for a woman — there was some reason to believe it would join powdered wigs in the dustbin of American legal history. No such luck.
While some (or several) attorneys are honest, there's a simple reason why no lawyer will defend your position as sternly you would: An attorney won't risk his/her cushy or soft-spoken relation with the judges in that court, lest the attorney finds himself (herself) forced to move his practice to another county/district/jurisdiction. In that sense, your cause is compromised by the lawyer without you knowing it.
analysis.124 The analysis below attempts only to assess the impact of the creation of the pro se office over its first five years of existence. Specific information about subsequent reforms implemented by the office is not readily available and hence not ripe for analysis. However, any such reforms may have had a different impact on case outcomes for pro se litigants and, accordingly, may indicate more promising future directions for pro se reform.

Self-Represented Litigants Network The Resource Guide provides options for courts and other entities interested in providing services to self-represented litigants using means that are not face-to-face, instead of, or in addition to, in-person alternatives such as walk-in services, workshops, and clinics.
If the pro se plaintiff fails to make a jury request, defense counsel should think hard as to whether a jury trial should be requested. Will the pro se plaintiff gain momentum in the eyes of the jury, simply because they are acting on their own behalf? Will defense counsel automatically be seen as part of the “system,” regardless of the merits of the case? Or, will the plaintiff come across as an unreasonable “zealot” who is out to seek revenge against the defendant with an incoherent set of facts and unlikable witnesses?
What happened in each of those cases? (1) Is the judicial system broken even in the U.S. Supreme Court? or (2) did these law offices team up in taking their client's money despite knowing that his position was devoid of merit? Logic prohibits to simultaneously answer both questions with a "no". Another possibility is that (3) these joint law offices genuinely misapprehended how the law applies to the controversy they litigated. Regardless, a pro se litigant who makes his best effort is exempt of the costly risks (2) and (3).

Importantly, this Comment does not suggest that these reforms have been failures. These reforms may have improved the pro se litigation process by making it feel more humane and easier to understand and by giving litigants a stronger sense that their concerns have been heard. Moreover, these reforms may still ease the burden of pro se litigation on courts by helping courts understand the issues involved more clearly or by moving cases through the judicial system more quickly. The analysis does suggest, however, that district court reforms have been ineffective in improving case outcomes for pro se litigants, and alternative approaches should be considered.
litigant’s interest in personal liberty, not the general interests of litigants in vindicating legal rights, was the critical question in determining whether the litigant has a right to counsel.39 Accordingly, in a blow to civil Gideon activists, the Supreme Court held that there was a “presumption that there is no right to appointed counsel in the absence of at least a potential deprivation of physical liberty,” signaling the Supreme Court’s reluctance to extend the right to counsel to civil litigants.40 Lassiter remains good law.
Pro se representation refers to a situation in which a person decides not to be represented by an attorney in a civil or criminal court case. The right of an individual to choose pro se representation dates back to pre-Constitutional times in the U.S. Although individuals have the right to represent themselves during legal actions, there are certain requirements. For example, the individual must have the mental capacity necessary to represent himself, which may be determined by the court, if questioned. Additionally, an individual choosing pro se representation must observe all of the rules of the legal action and the courtroom, just as an attorney would be expected to do.

(December 2017). This report describes case management reports that OES should consider producing on a regular schedule in an effort to better understand cases with self-represented litigants.
In one study, researchers identified almost 200 discrete tasks that self-represented litigants must perform in civil cases – from finding the right court to interpreting the law, filing motions, compiling evidence and negotiating a settlement. Some of these tasks require specialized knowledge of the law and of the court system. Almost all require time away from work and caring for children. Many also require the ability to get to the courthouse, to read and to speak English or access a translator.
2. Mediation: A flexible, non-binding dispute resolution process in which an impartial neutral third party--the mediator--facilitates negotiations among the parties to help them reach settlement. A hallmark of mediation is its capacity to expand traditional settlement discussions and broaden resolution options, often by going beyond the legal issues in controversy. In the District of Idaho, all civil cases except prisoner petitions, Social Security, student loan recovery, Medicare, forfeiture, Bankruptcy appeals, federal tax suits, Federal Tort Claims Act cases in excess of $1 million, cases involving Temporary Restraining Orders, Preliminary Injunctions or other extraordinary injunctive relief will be automatically assigned to mediation. In addition, all Bankruptcy adversary proceedings and contested cases shall be eligible for assignment to mediation. A party will be allowed to “opt out” of the mediation process only upon successfully demonstrating to the Court by motion that “compelling reasons” exist as to why this mediation should not occur or could not possibly be productive. Mediation is governed by General Order #130.
There is good reason to believe, however, that there are not major omitted variable issues in this data. There are three potential omitted variables that are important to address here, but none seems likely to be a confounding factor in this analysis.103 One key possibility is that district courts that have implemented more pro se reforms may differ from other district courts in that they have dockets with more (or fewer) pro se litigants. However, previous analysis suggests that is not the case.104 Another potentially important consideration is whether pro se reform is concentrated in a few district courts. But approximately 90 percent of district courts have implemented at least some services for nonprisoner pro se litigants, so this does not appear to be the case either.105 Finally, it could be the case that district courts typically implement either none or many of these reforms. However, similar numbers of district courts have implemented one, two, three, and four programs and procedures to assist pro se litigants;106 accordingly, there is no apparent all-or-nothing problem either.107 While this Comment does not claim that these are all of the potentially important omitted variables,108 it does seem that district court reform is a widespread practice used in different ways throughout those courts, suggesting that it is ripe for the type of analysis conducted here.109
Oftentimes, self-represented litigants become reactive when there’s a lawyer on the other side. Instead of getting ahead of things or running their own case, they let the lawyer take the lead. They spend so much time responding to discovery requests, summary judgment motions, motions to dismiss, and other filings that they don’t formulate a strategy of their own. They don’t do their own discovery or object to certain requests because they’re swamped and often intimidated. So, they’re always behind and in a constant reactive state. If a wise opponent sees how reactive you are, they can walk you right into an error. So, take control of your case. Never let a lawyer think that he’s in charge of it.
Your state’s “Rules of Court.” These are rules that set the procedures and deadlines that the courts in a state must follow. Generally, states have separate sets of rules for different kinds of courts. For example, a state may have one set of rules for its municipal courts (courts that try cases involving limited amounts of money), another for its superior courts (courts that try cases involving higher amounts of money), and still others for its appellate courts (courts that review the decisions of municipal and superior courts). All the rules may, however, be published in a single book. Some states also have separate sets of rules for specialized courts, such as family law courts, which hear cases involving divorce, child custody, and child support; or probate courts, which hear cases involving wills and trusts.
91. Property cases are an interesting exception, with a represented plaintiff still 0.88 times as likely to win a case against a represented litigant as against a pro se defendant. Though the noncausal nature of the comparisons weighs against drawing any overly significant inferences from this fact, it does suggest that the trend toward increasing numbers of defendants proceeding pro se in property suits might not be a particularly important issue.
